The following TERMS OF USE (“Terms”) governs your access to and use of this website (“Site”, “https://colasurdo.ca“) and any services, resources, information, features, or content made available through the Site (collectively referred to as “Services”). By accessing the Site or Services, you (“User”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree with these Terms, you must:
discontinue use of the Site immediately.

1. Website Operator
This Site is operated by:
Antonio M. Colasurdo (“Operator”),
located in the Province of Québec, Canada.

2. Eligibility & Age Requirements
Users must have reached the age of majority in their province or territory of residence to use the Site and Services. In Québec, the age of majority is 18 years old. By accessing the Site, you confirm you meet this requirement.

Offline professional services for minors may require parental or guardian authorization and are governed by separate agreements, outside the scope of these Terms.

3. Purpose of the Site
The Site provides access to information related to Pedorthics, Osteopathy, Kinesitherapy, Naturopathy, and Strength and Conditioning Training, and may allow for the booking of professional services. The Site does not provide medical, diagnostic, emergency, or physician services. Any professional services delivered offline or remotely are subject to separate clinical and/or training agreements and informed consent.

4. No Medical Advice Provided
Information on the Site is provided for informational and educational purposes only and should not be interpreted as medical advice, diagnosis, treatment, or individualized therapeutic instruction. No clinician-patient or therapist-patient relationship is formed through Site use alone. Users should consult qualified medical providers for health concerns.

5. TeleHealth or Remote Services
If TeleHealth consultations or remove coaching are offered,
Users acknowledge that:
remote services have limitations compared to in-person services,
emergency or urgent care is not provided remotely,
Users are responsible for ensuring a safe environment for participation; and
informed consent is required prior to service delivery.

6. License to Use the Site
The Operator grants Users a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No ownership or transfer of rights occurs through Site access.

7. Intellectual Property, Copyright, & Trademarks
All content on the Site, including but not limited to text, images, graphics, videos, service names, and logos, is the property of the Operator or its licensors and is protected under Canadian and international intellectual property law. No content may be reproduced or distributed without express written consent from the Operator or the license owners of the intellectual property in question.

8. User Restrictions
Users agree not to use the Site to:
engage in unlawful or fraudulent activities,
compromise security or functionality,
distribute harmful code or malware,
scrape or harvest data without consent,
distribute defamatory or infringing content,
impersonate others; and
interfere with system performance.

Violations may result in termination of access and potential legal action.

9. Reviews, Feedback, & Comments
If Users submit testimonials, reviews, comments, suggestions, or other content (“User Feedback”), they grant the Operator a royalty-free, worldwide, perpetual, irrevocable, sub-licensable license to use, publish, reproduce, and distribute such content for operational and marketing purposes. Users must ensure that submissions do not violate laws or rights.

10. Communications & Electronic Consent
By using the Site and/or submitting electronic forms across the Site, Users consent to receiving communications electronically. Electronic agreements and notices satisfy legal requirements for written documentation. Users may opt out of promotional communications but not transactional or service-related notices.

11. Cookies & Tracking Technologies
The Site may use cookies, web beacons, analytics tools, or similar technologies (“Cookies”) to enhance user experience, analyze traffic, and improve functionality. Users may adjust browser settings to refuse Cookies; however, doing so may impair Site functionality.

12. Fees, Payment, & Booking
Fees and payment terms will be disclosed prior to purchase and may be subject to Federal and Québec taxes. Cancellations, refunds, or rescheduling may be governed by a separate cancellation policy available on the Site and at booking.

13. Third-Party Links
The Site may contain links to third-party websites. Such links do not constitute endorsement. Users access third-party sites at their own risk and are responsible for reviewing third-party terms and policies.

14. International Users
The Site is controlled and operated from Québec, Canada. Users accessing the Site from outside Canada do so voluntarily and are responsible for compliance with local laws. The Operator makes no representation that the Site or Services are appropriate or legally accessible outside Canada.

15. Service Availability & Modification
The Operator may modify, suspend, or discontinue all or part of the Site or Services without liability and without notice.

16. Disclaimer of Warranties
The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. No guarantee of accuracy, reliability, availability, or fitness for purpose is made.

17. Limitations of Liability
To the fullest extent permitted by Québec and Canadian law, the Operator shall not be liable for indirect, incidental, special, consequential, or punitive damages, including damages arising from Site use or reliance on information. Where liability cannot legally be excluded, it is limited to the amount paid for Services in the preceding six (6) months.

18. Indemnification
Users agree to indemnify and defend the Operator from claims, losses, or damages arising from misuse of the Site, violation of these Terms, or violation of applicable law.

19. Force Majeure
The Operator shall not be liable for delays or failures to perform obligations due to circumstances outside reasonable control, including but not limited to natural disasters, government actions, pandemics, power outages, internet failures, labour disputes, war, or other unforeseen events.

20. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada. The parties agree first to seek resolution through good-faith negotiation. Otherwise, exclusive jurisdiction shall lie with the courts located in Montréal, Québec.

21. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22. Changes to Terms
The Operator may update or modify these Terms at any time. Continued use of the Site constitutes acceptance of the updated Terms. The Date of Last Revision indicates the most recent revision.

23. Acknowledgement & Acceptance
By using the Site, Users acknowledge that they have read, understood, and agree to be bound by these Terms.

This agreement has been written in English. In the event a translation of this agreement into any other language shall conflict with the English version, the English version controls.

Physicians are registrants of the College of Physicians and Surgeons, Antonio Colasurdo is not a physician and thus, he is not a registrant of the College of Physicians and Surgeons. Only a physician may, in the practice of his profession, make a medical diagnosis and establish a medical treatment to be respected.
